BBH assists in tendering process for the German EV charging network

The Federal Ministry of Digital Affairs and Transport (BMDV) issued a first call for tenders for the German EV charging network “Deutschlandnetz”. Ten businesses will set up around 900 fast-charging sites for e-vehicles. The BBH group provided legal support in the process.

There is an urgent need for a nationwide, demand-driven development of the charging infrastructure considering the rise in electric vehicles on German roads. The Germany EV charging network is designed to meet the charging needs of e-vehicles across Germany. The current call for tenders concerns urban, suburban and rural areas. The aim is to ensure that users can get to the next fast-charging point within a short amount of time with almost 8,000 fast-charging points for e-vehicles at about 900 locations. BBH provided the required special legal expertise for this complex tendering process, which was based not only on the bid price but also on the experience of the future operators as well as the user-friendliness and design of the future charging location. We also successfully assisted in the approval of the process with the European Commission under state aid law.

“The successful outcome of the tender is a genuine achievement: it enables a nationwide backbone for the charging infrastructure. This competitive tendering process has resulted in very attractive offers and is now bringing important improvements for e-vehicle users,” says BBH partner and lawyer Dr. Roman Ringwald. BBH partner and lawyer Dr. Christian de Wyl is pleased as well: “Negotiating with all bidders involved in the process was a main success factor: we succeeded in reconciling the ambitious plans of the Federal Government with the practical experience of the operators of charging facilities.” The two partners received particular support from the lawyers Tobias Reinhardt  and Lisa Angela Gut..
