Professional titles

The professional titles of BBH’s accredited professionals working in the German offices were conferred to them in the Federal Republic of Germany.

Professional liability

The professional indemnity insurance is provided by Allianz Versicherungs-AG, 10900 Berlin. The contract no. is: GHV 10/0459/1021151.

The territorial scope of the insurance coverage comprises legal advice in at least the European Union member states and complies with at least the legal requirements pursuant to section 51 of the Federal Lawyers’ Act (Bundesrechtsanwaltsordnung – BRAO) and section 54 of the Public Accountant Act (Wirtschaftsprüferordnung – WPO) in conjunction with the Regulation on the Professional Indemnity Insurance of accountants and certified chartered accountants (Verordnung über die Berufshaftpflichtversicherung der Wirtschaftsprüfer und vereidigten Buchprüfer – WPBHV) and section 67 of the Tax Advisory Act (Steuerberatungsgesetz – StBerG) in conjunction with sections 51 et. seq. of the Regulation on the Implementation of the provisions for tax advisors, tax agents and tax advisory companies (Verordnung zur Durchführung der Vorschriften über Steuerberater, Steuerbevollmächtigte und Steuerberatungsgesellschaften – DVStB).

Dispute settlement procedure

In regard to disputes relating to the provision of legal services, Becker Büttner Held PartGmbB (“the company”) is prepared to participate in an alternative dispute settlement procedure pursuant to the Act on the Alternative Dispute Resolution for Consumer Disputes (Gesetz über die alternative Streitbeilegung in Verbrauchersachen – VSBG).

According to this Act, consumers within the meaning of section 13 German Civil Code (Bürgerliches Gesetzbuch) (“consumers”) may – for the purpose of conducting a conciliation procedure – call on the consumer conciliation body (Verbraucherschlichtungsstelle) within the meaning of the Act on the Alternative Dispute Resolution for Consumer Disputes if they have previously made a complaint to the company. If no more than two months have passed since the claim under dispute was first notified to the company and if the company has during that time neither accepted nor rejected the claim under dispute, the company may request for the conciliation procedure to be suspended for the remainder of the two months. Filing the complaint with the consumer conciliation body suspends the statutory limitation period pursuant to section 204 subsection 1 no. 4 BGB. This does not affect the right of the parties involved to pursue the matter before the courts or to apply for a different procedure.

For online business transactions: Consumers may use the online dispute resolution (ODR) platform of the European Union to obtain free advice in regard to filing a consumer complaint relating to an online contract for the purchase of goods or services and to receive information on the procedures of the consumer conciliation bodies of the European Union.
