Sunday trading in Berlin: the State of Berlin, represented by BBH, prevails before the Federal Administrative Court

Yesterday, the Federal Administrative Court (Bundesverwaltungsgericht) confirmed the admissibility of the Sunday trading days in the first half of the year 2018 as determined by the Senate Administration for Integration, Labour and Social Affairs (Senatsverwaltung für Integration, Arbeit und Soziales). This is a success for the State of Berlin and the law firm Becker Büttner Held (BBH), which represented the State before the court of first instance and throughout the appeal process.

The trade union ver.di had filed a complaint against the Sunday trading days in the year 2018 and prevailed in summary proceedings before the Administrative Court (Verwaltungsgericht) of Berlin. However, the Higher Administrative Court (Oberverwaltungsgericht) of Berlin-Brandenburg annulled the ruling of the court of first instance. Now, the Federal Administrative Court has also confirmed the lawfulness of Sunday openings in Berlin.
