[Translate to English:] Large-scale PV project in Lower Saxony: BBH assists in complex tendering procedure

enercity AG will install photovoltaic systems on the roofs of around 500 state-owned buildings in Lower Saxony. The project was preceded by a complex and innovative award procedure, jointly advised by BBH and PD – Berater der öffentlichen Hand GmbH.

With this project, Lower Saxony will progress well towards achieving climate neutrality, as photovoltaic systems will be installed and operated by enercity AG on up to 355,000 square metres of roof surfaces on state-owned buildings in the districts of Emsland, Cloppenburg, Oldenburg, Vechta, Grafschaft Bentheim and Osnabrück, as well as the cities of Oldenburg and Osnabrück. If only half of the roof surfaces prove to be suitable, around 30 GWh per year can be generated in the future, which will mainly supply the buildings of the respective state properties in the long term.

The preceding award procedure was a novelty. It is the first public tender by a federal state for the installation and operation of photovoltaic installations on state-owned roofs by third parties while simultaneously aiming to purchase and consume the generated electricity on site. This complex procedure required the special expertise of PD – Berater der öffentlichen Hand GmbH and BBH’s expertise regarding energy and procurement law issues.

The BBH experts were able to provide support based on their experience, particularly regarding the complex requirements of the award procedure. “The fast implementation of the requirements set out in the revised Climate Change Act has been successful because all parties involved – despite the legal and practical complexity – want to make a significant contribution to climate protection,” say the BBH partners and lawyers Jens Panknin and Dr. Roman Ringwald.
